Our Services Privacy Statement covers our privacy practices as a controller in connection with the use of our hosted software applications and related support services. The Services Privacy Statement also describes our privacy practices with respect to customer and partner contact and account management information we process in connection with the purchase and use of our products and services or technology provided by our partners to our customers.

Purpose and Scope

Amplifier Inc., including its subsidiaries and affiliates (collectively, "Amplfier," "we," or "us") respects the privacy of users of its Website (as defined below) and registrants and attendees at its Events (as defined below), and of individuals with whom we may otherwise interact with for marketing purposes (collectively, “Data Subjects”).

This Privacy Statement (the "Privacy Statement") applies to our collection, use, and disclosure as controller of: (i) information obtained through the Amplifier websites that link to this Privacy Statement ("Website"); (ii) information collected at event registration or attendance information for events hosted by us or our business partners where we collect information from registrants and attendees (“Events”), or (iii) marketing communications that we issue to you where we have obtained your contact details in some other manner.

How We Obtain Information

We collect several types of information from and about Data Subjects that broadly fall into the following categories:

1. Information we collect from you:

  • When filling out forms on our Website (including without limitation, name, mailing address, email address, and telephone number).
  • When you post material to our Website, participate in bulletin boards, chat rooms, blogs, comment threads, forums, or other interactive features of our Website, register, or request further information or services from us.
  • When you register to use a demo or developer instance of our cloud service.
  • When you enter a contest or promotion we sponsor.
  • When you contact us (including where you interact with chatbots on our Website).
  • When you complete our surveys.
  • When you register for or attend an Event (which may include photographs, audio, and video recordings of Event attendees).
  • Other information you may submit to us related to your use of our Website or attendance to an Event (including without limitation, billing information).

2. Information from third parties or information which is publicly available.

From time to time, we may collect and use information we receive about you from third parties in connection with your use of the Website or attendance to an Event or other marketing related activities. For instance, we may receive information about you from our business partners related to your registration information for Events or from other vendors where you have expressed an interest in Amplifier products (including by downloading a Amplifier digital asset or giving consent to receiving marketing materials).

We also use third parties for reporting and analytics to measure the effectiveness of our Website and marketing efforts, and to identify areas for improvement.We may combine information we collect from third parties with information you provide us to update, expand, or provide you with tailored information regarding our products, services, and Events.  We may also collect information about you where you have made it publicly available.

3. Information we collect as you navigate through the Website.

As you navigate through the Website, we may also automatically collect details about your visits to the Website, including your IP address, usage patterns, traffic data, location data, logs, other communication data, and the resources that you access, as well as information about your device and internet connection, including your operating system and browser type.

We also collect some of this information using cookies and similar tracking technologies through others that we engage to provide analytics services, serve advertisements, and perform related services across the web and in mobile apps. You can turn off cookies used for ad targeting purposes by accessing the “Cookies Preferences” link in the footer of the site.

When you visit our website, cookies  and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or home address. How We Use Information Collected

We may process personal data that we collect about you for the following purposes:

  • To register you for Events you sign up for with us and populate profiles for you in our records.
  • To provide you with information about products or services that you request from us.  To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including without limitation, our Website Terms of Use.
  • To notify you about changes to our Website or obtain any required consent.
  • To allow you to participate in interactive features of our Website, when you choose to do so.
  • For industry analysis, benchmarking, analytics, marketing, and other business purposes.
  • To track your browsing behavior, such as the pages you visited over time, for analytics and advertising purposes.
  • To communicate with you about Events.
  • To contact you for marketing purposes, in accordance with your marketing preferences (for example, we may use your information to contact you to further discuss your interests in our services and products or other Events).
  • To promote our products, services, or Events on our social media accounts (for example, by using photographs, audio, and video recordings of Events which you may have attended).

If you ask us to contact you about goods and services, we may use your personal data, or permit selected third parties to use your personal data, to contact you about such goods and services. How We Disclose Information Collected

We may disclose personal data about you to the following categories of recipients:

  • To our global subsidiaries and affiliates who will use it only for the purposes described in this Privacy Statement.
  • To our contractors, business partners and service providers we use to support our business or who provide services on our behalf.  If you choose to disclose your information to business partners or sponsors, your information will be subject to the respective business partner or sponsor’s privacy statement.
  • To a potential buyer (and its agents and advisors) in connection with any proposed merger, acquisition, or any form of sale or transfer of some or all of our assets (including in the event of a reorganization, dissolution or liquidation), in which case personal data held by us about you will be amongst the assets transferred to the buyer or acquirer.
  • To any competent law enforcement body, regulatory, government agency, court or other third party  to: (i) comply with relevant laws and regulations, including court order, a request from any competent law enforcement agency, or any other legal obligation; (ii) enforce or apply our Website Terms of Service, or terms of any other agreement, or to take action regarding violations of our policies; (iii) protect the rights, property, or safety of Amplifier, its affiliates, employees, agents, or others, (iv) defend against a legal claim.
  • To any other user of the site or any other sites in the Amplifier ecosystem, where you choose to make that information public.

We may also disclose aggregated or de-identified information that cannot reasonably be used to identify you. Amplifier processes, maintains, and uses this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

International Transfer of Data

Amplifier stores and processes any personal data collected in connection with Data Subjects in: (i) any country where we have facilities, (ii) any country in which we engage service providers; or (iii) any country where Events are held.

For international transfers of personal data from the European Economic Area ("EEA"), the UK or Switzerland, we implement such measures as are necessary to ensure we provide appropriate safeguards for the transferred data, including through the use of Standard Contractual Clauses or another lawful transfer data transfer mechanism.

International Transfer of Data

Amplifier maintains appropriate technical and organizational measures designed to protect the personal data of Data Subjects from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, and access. Amplifier personnel and service providers with access to personal data of Data Subjects are required to keep such information confidential and secure.

Retention

We will retain your personal data if we have a business need to do so or for as long as is needed to fulfil the purposes outlined in this Privacy Statement, unless a longer retention period is required by law (for example, to comply with applicable legal, tax, or accounting requirements).When we have no ongoing legitimate business need to process your personal data, we will either delete or anonymize it or if this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store your personal data and isolate it from any further processing until deletion is possible.

In accordance with applicable laws, we provide you with certain choices regarding the information you provide to us.  Depending on where you reside, you may have the following rights:

  • If you wish to access, correct, update, or request deletion of your personal data, you can contact us. Event registrants and attendees may update their user profiles for Events we host by logging into the applicable event website or registration page.

We will process your requests to exercise such rights, including if you object to processing of your personal data, ask us to restrict processing of your personal data, or request portability of your personal data, in accordance with applicable data protection laws.
  • If you do not wish to receive our email marketing communication for promotional purposes, you may opt out by clicking on the “unsubscribe” or “opt out” link in the marketing emails we send you. To opt out of other forms of marketing (such as telemarketing), please contact us. You have the right to (1) request to know more about and access your personal data, including in a portable format, (2) request deletion of your personal data, and (3) request correction of inaccurate personal data To request access, correction, or deletion of your personal data, please submit your request to privacy@amplfiersecurity.com. Once we receive the request, we will verify your request. Event registrants and attendees may update their user profiles for Events we host by logging into the applicable event website or registration page.

Non-discrimination

We will not discriminate against you if you choose to exercise your rights under the CCPA or any other rights you may have in respect of your personal data.

Please note that any information you post or disclose in public forums will become public information, and may be available to users and the general public. We urge you to be very careful when deciding to disclose your personal data, or any other information in our public forums. Proper access and use of information provided on the Website, including contributions to our public forums, is governed by our Website Terms of Use and known or suspected violations should be reported to us.

Children

We do not knowingly collect personal data from anyone under the age of 16. If you are under 16, please do not attempt to fill out our forms or send any personal data about yourself to us. PRIVACY STATEMENT FOR AMPLIFIER SAAS PURPOSE AND SCOPE

Amplifier Inc., including its subsidiaries and affiliates (collectively, "Amplifier," "we," or "us") respects the privacy of individuals.

This Services Privacy Statement (“Services Notice”) applies to our collection, use, and disclosure of information obtained in connection with the provision and use of our hosted software applications  and Mobile Applications  (collectively, the "Subscription Service"), and related support services ("Support Services"), as well as professional services, including training and certification (the "Professional Services") that we provide to Customers (defined below). In this Services Notice, the Subscription Service, Support Services, and the Professional Services are collectively referred to as the "Service."

This Services Notice does not apply to a Customer's use or disclosure of any information it stores in the Subscription Service. This Services Notice also does not apply to information or data collected by Amplifier for other purposes outside of or unrelated to the Service.

For the purposes of this Services Notice:

  • “Customer” means the entity that purchases our Service.
  • “Customer Agreement” means the definitive agreement between Customer and Amplifier pursuant to which the Customer purchased access to the Subscription Service.
  • "Customer Data" means the electronic data uploaded into the Subscription Service by or for Customer or its Users.
  • “Account Data” means a Customer or Partner’s name and address, credit card or billing information, and the Customer or Partner representatives’ contact information.
  • “Usage Data” means quantitative, anonymized, pseudonymized, or aggregated data derived from Users’ use of the Service. For the avoidance of doubt, Usage Data does not include Customer Data.
  • “Account Data” means a Customer or Partner’s name and address, credit card or billing information, and the Customer or Partner representatives’ contact information.
  • “User” means an individual authorized by the Customer or Partner to access and use the Subscription Service.
  • “Partner” means an entity that sells Amplifier products and services or provides services or technology to Amplifier customers that relate to the Service.

HOW WE OBTAIN INFORMATION

We collect several types of information from and about our Customers, Users and Partners in the course of hosting, providing, maintaining, supporting and improving our Service.  We process several types of information from the Service as a data processor for our Customers, including:

  • Information and correspondence submitted to us in connection with our provision of the Service.
  • Information we receive from our business partners in connection with provision or use of the Service or in connection with services provided by our business partners, including configuration of the Subscription Service.
  • Server logs and any other ancillary data required to be processed in support of or in relation to the operation of the Service and the security of Customer Data.

We also process certain types of information from the Service as a data controller, including Account Data, Usage Data and certain User login data for certain Services.

HOW WE USE INFORMATION

We may process personal data within the Customer Data to provide and support the Service. We do not use, disclose, review, share, distribute, transfer, or reference any Customer Data except as permitted in the Customer Agreement or as required by law.

In addition, we may use Account Data for billing, account management and contracting purposes. We process Usage Data for general maintenance, support, security, and improvement of the Service. We also process User log-in data to administer individual accounts related to training/learning activities.

LEGAL BASIS

To the extent that we process Customer Data as a data processor, we do so in accordance with the Customer Agreement and the Customer’s instructions.

To the extent that we process Account Data or Usage Data or certain User log-in data as a data controller, we do so on the basis of our legitimate business interest to do so (taking into account the fundamental privacy rights of any relevant individuals), and/or on the basis of compliance with a legal obligation, and/or on the basis of consent, depending on the specific activity involved.

Where we have prior Customer agreement, we may process Customer Data as data controller for the purpose of training Amplifier’s artificial intelligence (“AI”) and machine learning (“ML”) models.  Any processing is conducted on the basis of the legitimate interests of both Amplifier and our Customer, in order to improve of these AI and ML models and, therefore, to provide a more accurate and reliable service to Amplifier’s Customers and Users.  Where applicable, we also take steps to minimize the amount of personal data processed for this purpose. Users may exercise their right to object to this processing by contacting us. For further information on the exercise of your rights please see section “Your Privacy Rights” below.

HOW WE SHARE INFORMATION COLLECTED

We may disclose personal data comprised in Customer Data, Account Data or Usage Data to the following categories of recipients:

  • To our contractors, business partners and service providers we use to support our Service and business partners who provide services on behalf of our Customers.
  • To a potential buyer (and its agents and advisors) in connection with any proposed merger, acquisition, or any form of sale or transfer of some or all of our assets (including in the event of a reorganization, dissolution or liquidation), in which case personal information held by us about our Customers and Partners will be among the assets transferred to the buyer or acquirer.
  • To any competent law enforcement body, regulatory, government agency, court or other third party to: (i) comply with any court order, a request from any competent law enforcement agency, or any other legal obligation; (ii) enforce or apply the terms of the Customer Agreement; (iii) enforce or apply the terms of the agreement for partnership with our Partners; and (iv) protect the rights, property, or safety of Amplifier, our Customers, Users, or others.
  • In accordance with Customer instructions.

(App’s) use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy - https://developers.google.com/terms/api-services-user-data-policy#additional_requirements_for_specific_api_scopes, including the Limited Use requirements.

INTERNATIONAL TRANSFERS

We may store and process Customer Data, Account Data and Usage Data in: (i) any country where we have facilities, and (ii) any country in which we engage service providers.For international transfers of personal data from the EEA, UK or Switzerland, we will implement such measures as are necessary to ensure we provide appropriate safeguards for the transferred data, including through the use of Standard Contractual Clauses or another lawful transfer data transfer mechanism.

SECURITY AND BREACH NOTIFICATION

We maintain an information security program designed to protect personal data which we process from accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access. The Customer Agreement sets out specific details on how we secure Customer Data. The Subscription Service allows Customers to implement and configure their use of the platform and enforce their security requirements. Amplifier has a dedicated team responsible for monitoring and responding to security incidents. Amplifier notifies Customers of security breaches in accordance with the Customer Agreement.

RETENTION

We retain Customer Data according to the timeframes set forth in the Customer Agreement.In circumstances where we are a data controller, we retain personal data only for so long as we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax, or accounting requirements, or to maintain a record of consent preferences).

MOBILE APPLICATIONS

We may obtain additional information through Mobile Applications that Customer or their Users download to their mobile device (“Device”).  Mobile Applications we provide may obtain or collect information from a User’s Devices in connection with the User’s use of the Subscription Service, and are designed to interoperate with the Subscription Service; for instance, to provide a User with access to information within the Subscription Service or to provide information from a User’s Device to the Subscription Service.

In order to provide and operate the Mobile Applications, we need certain information from the User, and without that information our Mobile Applications wouldn’t work (or wouldn’t work very well). For example, we ask Users to provide some personal information, such as login credentials to access and use the Subscription Service through the Mobile Applications. In addition to the personal information Users provide, we also collect certain other personal information through the use of our Mobile Applications. For instance, Mobile Applications may use a Device’s geolocation data to provide services available through the Mobile Applications, including to send Users notifications. If a User has geolocation turned on, the Mobile Applications will, from time to time, tell us about a User’s Device’s location even if a User is not directly interacting with the Mobile Application. It may also tell us about a User’s Device location while the User is interacting with the Mobile Application. We may only be able to collect some of this information if the Device settings allow it, so Users should always review our Mobile Applications settings under the Device settings menu to select what information Users are happy for apps like ours to access or not to access.

Our Mobile Applications may also provide us with information related to a User’s use of the Mobile Applications, including information regarding a User’s Devices and OS identification, language, and time zone. Mobile Applications may also collect information regarding a User’s interaction with Mobile Applications, which Amplifier may use to provide and improve the Mobile Application and Services. We may also obtain information when Users report a problem with our Mobile Applications. In addition, we may use information collected by our Mobile Applications to enforce our rights arising from contracts we enter into with the Customer or with a User.

We may disclose User’s information to law enforcement, competent government authorities, court and other third parties where we believe are required to do so by applicable law or regulation (including a court order), or where we believe disclosure is necessary to exercise, establish or defend legal rights or to protect the vital interests of any person. If a third party buys all or part of our business or assets, then we may also disclose User information in connection with the sale.  Where we do, we will inform the third party that it is required to use User’s information only for the purposes set out in this Services Notice. We may also share a User’s personal information to any other person with such User’s consent to the disclosure.

In addition to Mobile Applications we provide, third party Mobile Applications may be made available for download to a User’s Devices.  The collection and use of information through third-party Mobile Applications (if any) is governed by the applicable privacy notices of such third parties. Contractual terms related to a particular Mobile Application may be found in the End User License Agreement or relevant terms of service for that application.

YOUR PRIVACY RIGHTS

Since each Customer is in control of what information, including any personal information, it collects from its Users, how that information is used and disclosed, and how that information can be changed, Users of the Subscription Service must contact the applicable Customer administrator with any inquiries about how the Customer uses and discloses personal information contained within Customer Data and how to access, rectify, correct, delete, and port personal information contained within Customer Data as well as object to or restrict the processing of personal information contained in Customer Data.

We provide you with certain choices regarding the personal data you provide to us which we process as a data controller. In particular:

  • Certain jurisdictions, for example the European Economic Area, provide their residents specific privacy rights under applicable law. We will process requests to exercise such rights, including objection to, restriction of processing, and requests for portability, access, correction, deletion of personal data contained  in accordance with applicable data protection laws. You may send us an email at privacy@amplifiersecurity.com to request the exercise of such rights.
  • Certain jurisdictions, for example certain States in the USA such as California, provide their residents with additional control over how their data is shared/sold. Amplifier does not sell personal data obtained from the operation of the Services to third parties. Amplifier does not share this data for cross context behavioral advertising.

Amplifier Inc., including its subsidiaries and affiliates (collectively, "Amplfier," "we," or "us") respects the privacy of users of its Website (as defined below) and registrants and attendees at its Events (as defined below), and of individuals with whom we may otherwise interact with for marketing purposes (collectively, “Data Subjects”).

We also use third parties for reporting and analytics to measure the effectiveness of our Website and marketing efforts, and to identify areas for improvement.
